What is diminished value?
It is the market value your vehicle permanently loses because it now has an accident on its history, even after a flawless repair. A buyer pays less for a car with a wreck on the Carfax than for an identical one without. In Utah that loss is typically $3,000 to $8,000, and the at-fault driver's insurer owes it.
Can I still claim diminished value if my car was in a previous accident?
Usually not, and we will tell you that up front. Diminished value measures the drop caused by THIS crash. If the vehicle already carried a significant or moderate accident on its record, the market had already discounted it, so there is little left to recover and carriers deny those claims. Minor or cosmetic prior damage is different and does not disqualify you.
How long do I have to file a property damage claim in Utah?
Three years from the date of the accident, under Utah Code 78B-2-305. Personal injury runs on a separate four-year clock. Do not wait, though. Evidence disappears, repair records get lost, and adjusters get harder to move the longer a claim sits.
What does it cost?
A diminished value appraisal is a $400 flat fee and a total loss appraisal is $350. Or choose our contingency option, where we take a percentage of whatever we recover above the insurer's first offer, so you pay nothing if we do not beat their number. My car was totaled. Do I have a diminished value claim too?
No. Those are different claims and you get one or the other. A totaled vehicle has no diminished value because you are not keeping it. What you do have is a total loss claim, and insurers routinely undervalue those. We recover an average of $6,500 above the first offer.
